Here are the official rules and regulations of this contest, please read it through very carefully.
OFFICIAL RULES
NO PURCHASE NECESSARY TO PARTICIPATE OR WIN. A PURCHASE OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.
1. Sponsor.
The host (“Host”) of this contest is The Unfused Journal. The sponsors (“Sponsors”) for this contest are Sapphire Technology Ltd. ("Sapphire") and Advanced Micro Devices Inc. ("AMD").
2. Eligibility.
The Agent Ruby contest is open only to legal residents of the world who are 18 or older, and who completely fill out the entry form. Employees of the Sponsors and Host, their respective subsidiaries, affiliates, agents, and the immediate families (defined as parents, children, siblings and husband or wife) of each such persons, as well as those with whom such persons are domiciled, are not eligible to participate. By participating in the contest, participants warrant that they are eligible to participate under the applicable laws governing procurement of prizes and awards. Sponsors reserve the right to disqualify any participant if Sponsors determine that participant’s participation in the contest or receipt of prize would violate international or local law. Participants may be required to submit proof of their eligibility.
3. Agreement to Official Rules.
Participation in the contest constitutes participants full and unconditional agreement to and acceptance of these Official Rules.
4. Entering and Winning.
To participate, the participant must completely fill out and submit the entry form with their story between 28 January 2011 and 15 February 2011. All entries must be received by 11:59 PM PST on 15 February 2011. Hosts’ computer systems will be the official time-keeping device of this contest.
Limit: Only one (1) entry per person or e-mail address. Multiple entries from the same person or e-mail address will not be accepted. Sponsors and Host are not responsible for lost, late, incomplete, invalid, illegible or misdirected entries, which will be disqualified or for any error, human, technical or otherwise. Host reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of the contest or to be acting in violation of these Official Rules. You are required to "like" our Facebook page to participate in this event and the same email address alocated to your Facebook account must be used when submitting your story.
The story must be written in English, it will otherwise be discarded.
Winner(s) need not be present at the time of the drawing to win. Host will select winner(s) from the correct received entries on or about 5:00 P.M. PST On 18 February 2011. Odds of winning does not depend on total number of eligible entries received.
5. Prizes.
Grand Prize(s): AMD Radeon™ HD 6850 graphics card. (Approximate Retail Value: $175 USD.), 3 CeBit 2011 entry tickets, an official AMD T-Shirt and a Stormrise voucher.
Second Place Prize(s): 3 CeBit 2011 entry tickets, an official AMD T-Shirt and a Stormrise voucher.
Third Place Prize(s): 2 CeBit 2011 entry tickets and an official AMD T-Shirt and a Stormrise voucher.
Other Participant Prize: 1 CeBit 2011 entry ticket (These are electronic tickets, a code will be sent to you which would allow you to print out the actual ticket. The codes will be given out WHILE THEY LAST at random) and an official AMD T-Shirt, also while they last. The CeBIT ticket will also give you free access to transportation to the convention during opening days.
Prizes are not transferable, and no cash substitutes for prizes are available, except by Sponsor, which reserves the right, in its sole discretion, to substitute different prizes of comparable value. All decisions regarding the prizes, including without limitation colors, packaging, and applicable sub-model designs, will be made by Sponsors in their sole discretion. Sponsors decisions shall be final and conclusive in all matters relating to the contest. Applicable local, state, federal and international taxes and any customs charges or tariffs on prizes are the sole responsibility of and must be paid by the winner(s).
6. Prize Notification and Delivery.
Potential winners will be notified via e-mail or telephone. Host will attempt to notify potential winners by reasonable means, using the contact information provided by the participant on his or her completed entry. Each potential winner may, at Host’s discretion, be required to sign and return an affidavit of eligibility and release of liability, as well as a publicity release, except where prohibited by applicable law. Failure to return a signed affidavit and release of liability prior to accepting delivery of the prize may result in forfeiture of the prize, except where prohibited by applicable law. Proof of sending will not be deemed to be proof of receipt by Host. If for any reason a potential winner cannot be reached after a reasonable attempt has been made, or does not return a signed affidavit and release, the prize will be awarded to an alternate winner. The prize will be sent to the address provided by participant on his or her completed entry. Allow up to four (8) weeks for delivery. Failure to comply with any term or condition in these Official Rules may result in disqualification at Host’s sole discretion. Potential winner(s) may waive their right to receive a prize, in which case an alternate winner will be selected in the manner described above. The reporting and payment of any taxes on prizes are the sole responsibility of the winner(s). Any applicable forms will be filed with the appropriate taxing authority.
7. General Conditions.
Except where prohibited by applicable law, participation in the contest constitutes each winner’s consent to Host and/or Sponsor’s use of the winner’s name, city, state, province or county, and country, likeness, photograph, statements made by the winner about the contest, Sponsor, and/or prize information for promotion purposes in any media without further payment or consideration. BY RECEIPT OF ANY PRIZE, EACH WINNER AGREES TO RELEASE AND HOLD HARMLESS HOST, SPONSORS, ITS SUBSIDARIES, AFFILIATES, AGENTS AND THEIR RESPECTIVE OFFICERS, DIRECTORS AND EMPLOYEES FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN THE CONTEST OR RECEIPT, POSSESSION, USE OR MISUSE OF THE PRIZE. All entries become the property of Host, and none will be returned. Host reserves the right to cancel or modify the contest if fraud, technical failures, sabotage, security breach, or any other factor beyond Host’s reasonable control impairs the integrity of the contest as determined by Host in its sole discretion. In such event, Host reserves the right to award the prizes at random from the eligible entries received up to the time of the impairment.
8. Miscellaneous.
Participant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this contest, or any prizes awarded, other than the administration of the contest or the determination of winners shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this contest, but in no event attorneys’ fees; and (3) under no circumstances will participant be permitted to obtain awards for and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of each participant, Host and Sponsor in connection with the contest, shall be governed by, and construed in accordance with Sponsor local law, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the laws of the Sponsors country.
